Ashley Smart, 41, was allegedly high on heroin when his two-year-old son drowned in the backyard pool. He now faces aggravated manslaughter and drug possession charges
A Florida man faces aggravated manslaughter charges because he was allegedly high on heroin while he was supposed to be watching his two-year-old son who drowned in a swimming pool.
In addition to manslaughter charges, Ashley Smart, 41, of Fleming Island, Florida, has been charged with possession of heroin and marijuana, according to authorities.
Cops responded to Smart's home on Tuesday morning after receiving an emergency call at about 10.30am, stating that his toddler son, Aiden Keith Smart, was unresponsive and turning blue, according to The Florida Times-Union.
The toddler was taken to Baptist Clay Medical Campus 'in full cardiac arrest,' according to News4Jax. He was pronounced dead at about 11am.
Authorities have not revealed where Smart was at the time when his son drowned in the swimming pool behind their house.
Aerial photos of the house show that the pool was surrounded by a safety fence, though.
Investigators said that they found .07 grams of heroin in a kitchen cabinet and 2.5 grams of marijuana on the dining room table while searching the house, according to CBS 47.
The seven small bags of heroin — five full and two empty — were found near three hypodermic needles. Cops also found a spoon with a piece of cotton and a bloodied tourniquet.
