RERA Draft Lets Gurgaon Builders Off The Hook, Will Reply Legally: Homebuyers

The homebuyers in Gurgaon have decided to challenge the real estate regulatory authority (RERA) in court if the Haryana government does not adopt suggestions and implement the draft bill in its present form.

The buyers are meeting at Leisure Valley Park in Sector 29 on Sunday before submitting their objections to the draft bill put out by the Haryana government.

In the present draft of RERA, it has been said that the developer which has obtained an occupancy certificate (OC) partially or fully for a project will be exempted from the ambit of the authority.

Homebuyers said the occupancy certificate has been obtained by a large number of developers in Gurgaon, but none has gotten a completion certificate, which certifies that a project is complete, as per approved rules.

The buyers said if the draft bill is approved in its current form, then no builder in Gurgaon will come under RERA and buyers and occupants in housing projects will continue to suffer with no recourse to approach the regulatory authority.

S Oberoi, resident of Uniworld Garden, Sohna Road, said, “If we adopt RERA draft in the present form, every developer in Gurgaon will escape its ambit. We want every project or developer, including DLF, Ansal, Unitech and Vatika, to be under RERA since they have incomplete projects, as per rules. None of the builders has obtained a completion certificate. In Gurgaon, only Garden Estate, located opposite Guru Dronacharya Metro station, has obtained a completion certificate. So our message to the government is clear — that it must treat all projects, including ongoing ones, equally under RERA.”

Oberoi, who is looking into the legal aspects of the draft, said a completion certificate means that the competent authority has certified that the real estate project has been developed according to the sanctioned plan, layout map and specifications, as approved by the government.

“An occupancy certificate means that the competent authority has permitted occupation of a building, as provided under local laws, and the building has provision for civic infrastructure such as water, sanitation and electricity,” said Oberoi, adding that buyers will wait for the government move now.

According to buyers, builders must be directed to immediately upload all information as per RERA 2016.

Meanwhile, the federation of apartments’ owners association has appealed to buyers to join the meeting at Leisure Valley Park on Sunday.

“The present provision to give easy escape to builders has annoyed us. This amounts to cheating innocent buyers,” said Gaurav Prakash, a home buyer and member of the federation.

National real estate development council (Naredco) president Pravin Jain, meanwhile, said, “RERA draft is perfect and we assure buyers of cooperation from the developers’ side in order to make the system efficient and effective.”
